These Terms & Conditions (“Terms”) govern your access to and use of the Emobot mobile application (“App”) and related services (collectively, the “Service”), operated by [Your Legal Entity] (“we,” “our,” or “us”). By downloading, accessing, or using the Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account, downloading, or using Emobot, you acknowledge that:
  • You have read, understood, and agree to these Terms.

2. Eligibility

  • You must be 13 years or older to use the Service.
  • If you are under 18, you must have parental or guardian consent.
  • You are solely responsible for ensuring compliance with laws applicable in your jurisdiction.

3. Purpose of the Service

  • Emobot provides emotional support, motivational content, and self-help tools.
  • It is not a medical, clinical, or therapeutic service.
  • The Service is not a substitute for professional advice, diagnosis, or treatment.
  • In emergencies, call your local emergency number.

4. Accounts and Access

  • To use certain features, you may be required to create an account.
  • You are responsible for maintaining the confidentiality of your account details.
  • You must immediately notify us of any unauthorized access to your account.

5. Pro Subscriptions

  • Some features are available only through a paid Pro Subscription.
  • Subscriptions are billed through the App Store or Google Play Store.
  • Auto-renewal: Subscriptions renew automatically unless cancelled at least 24 hours before the renewal date.
  • Cancellations & Refunds: Managed via your app store account; we do not process direct refunds.

6. Acceptable Use

You agree not to:
  • Use the Service for unlawful, harmful, or abusive purposes.
  • Attempt to hack, modify, or reverse-engineer the Service.
  • Harass, threaten, or send inappropriate content to others via the Service.
  • Upload any malicious software, spam, or harmful code.

7. User Content

  • You retain ownership of messages and content you submit (“User Content”).
  • By submitting User Content, you grant us a non-exclusive, royalty-free, worldwide license to process and store it for the purposes of operating the Service.
  • You are responsible for ensuring your content does not violate any laws or third-party rights.

8. Intellectual Property

  • The Emobot name, logo, design, features, and all related intellectual property are our exclusive property.
  • You may not copy, reproduce, distribute, or create derivative works without written permission.

9. Termination

We reserve the right to suspend or terminate your access to the Service if:
  • You violate these Terms.
  • We are required to do so by law.
  • We discontinue the Service.

10. Disclaimers

  • The Service is provided “as is” and “as available” without warranties of any kind.
  • We do not guarantee uninterrupted, error-free operation, or that results will meet your expectations.
  • Motivational and supportive content is general in nature and not tailored to specific clinical needs.

11. Limitation of Liability

  • To the maximum extent permitted by law, our liability for any claims is limited to the amount you paid for the Service in the 12 months preceding the claim.
  • We are not liable for indirect, incidental, or consequential damages.

12. Changes to the Service

We may update, modify, or discontinue features without prior notice.
We may also revise these Terms, and continued use after changes means you accept them.

13. Governing Law & Jurisdiction

  • These Terms are governed by the laws of England & Wales (unless updated for your jurisdiction).
  • Any disputes will be subject to the exclusive jurisdiction of the courts in that jurisdiction.
